Terms of service
1) Preamble
The seller is Lithos Natural GmbH, address: Wirtschaftszeile Ost 10, A-4482 Ennsdorf, UID: ATU 71856823; Company register number: FN461725h. The following conditions apply to all contracts, orders, deliveries and other services. Differing rules of the contractor, we hereby expressly oppose. All additional agreements require written confirmation from us!
2) Offer
All prices stated in the webshop are euro amounts and include the statutory sales tax of 20%. Small deviations, design changes and technical changes compared to our illustrations or descriptions are possible without this giving rise to any rights for the buyer. The pricing is based on the currently applicable legal regulations (e.g. Taxes, truck tolls,…). If these change, we reserve the right to change prices at any time.
3) Delivery and payment
3.a) Webshop
The goods will be dispatched within 1-8 working days of receipt of the order, depending on availability. The transport costs will be passed on to the customer. In the event of non-delivery, we will charge double the transport costs!
Payment is made using SOFORT banking, credit card, EPS, Klarna Pay later, Klarna Pay Now, PayPal or Apple Pay. The payment term is 14 days net after receipt of the invoice.
3b) B2B transactions
Delivery takes place according to agreement; if delivery times differ, these will be communicated to the customer immediately. The choice of forwarding company is made by Lithos; after consultation, the transport can be organized by the customer. In this case no transport costs will be charged. In the event of non-delivery, we will charge double the freight costs!
As standard, payment is due net within 14 days of receipt of the invoice. Lithos reserves the right to demand advance payment in individual cases before the goods are dispatched.
3c) Late payment
If the customer is in arrears with his payments, the seller can demand statutory default interest (§ 456 UGB) as well as reimbursement of the statutory flat-rate reminder fees (§ 458 UGB) and other collection costs from the due date. In the event of delayed payment or in the event of failure by the customer to provide agreed security on time, the seller may, after written notice to the customer, suspend the fulfillment of its own obligations until receipt of payment or until security is provided.
In the event of default, the customer undertakes to reimburse the tariff costs for engaging a debt collection agency in accordance with Federal Law Gazette 1996/141.
4) Bank details
You will receive the bank details required for the transfer after the order has been placed!
5) Right of withdrawal
The right of withdrawal applies to shipping within the EU. The following right of withdrawal only applies to unopened/sealed goods. You can cancel your order within 14 days of receiving the goods without giving any reasons. The cancellation must be made in writing or by returning the goods. To meet the deadline, it is sufficient to send it to Lithos on time. In the event of a revocation, we may Payments made will be refunded upon receipt of the goods. You are obliged to return the goods at your own risk if you have not already done so together with the cancellation letter. In any case, you must bear the costs of shipping and return. When returning items from abroad, please frank them properly! We refuse to accept shipments that are sent freight forwarded. If damaged or used goods are returned, Lithos is entitled to claim compensation.
6) Liability
Lithos assumes no liability for any damage caused by the use of the purchased products, especially if used improperly. Claims for damages arising from torts are excluded.
7) Guarantee/Warranty
The statutory warranty is 2 years from delivery. In the event of complaints, the purchase date must be proven with an invoice and the complained item must be sent to Lithos or brought in personally. The warranty does not cover normal wear and tear. The warranty expires if the customer changes the delivered goods or if they are used improperly. Lithos has the right to free repairs during the warranty period. Partial or total replacement of the item is also permitted. If defects are not remedied within a reasonable period of time, the buyer is entitled to cancellation or reduction.
8) Retention of title
The goods remain the property of Lithos until full payment!
9) Intellectual property
Lithos reserves all rights to every design, every text and every graphic on its website. Copying or other reproductions of the entire website or Parts of this website are only permitted for the purpose of placing an order with Lithos. The name Lithos Natural, all page headers, navigation bars, graphics and button symbols are registered trademarks, trademarks or trademarks of Lithos Natural GmbH. All other trademarks, product names or company names mentioned on this website or – Logos are the sole property of the respective owners. Lithos reserves the ownership rights and copyrights to illustrations, drawings, calculations and other documents. Before passing it on to third parties, the customer requires the express written consent of Lithos.
10) Data protection
Lithos assures that when collecting, processing and using personal data, the provisions of the Austrian Data Protection Act and the relevant legal standards will be observed. The customer data generated during order processing is only used for internal market research purposes. Data will only be passed on to third party companies to the extent absolutely necessary for the proper provision of services (order processing). The customer agrees to this use of his data. Furthermore, upon request, he has the right at any time to view the data stored about him and to prohibit its use for internal market research purposes.
11) Place of jurisdiction and applicable law
The place of jurisdiction is the registered office of Lithos Natural GmbH. The legal relationship is subject to Austrian law.
12) Final provisions
When selling the goods specified in print catalogs, flyers and in the online store of Lithos Natural GmbH, the General Terms and Conditions apply exclusively in the version valid at the time the respective contract is concluded. These terms and conditions apply in particular even if they differ from those of the customer. The manufacturer's license terms and conditions enclosed with and/or contained on the data carrier also apply to the delivery of software. By opening the sealed data carrier, the customer expressly acknowledges the validity of these conditions. Should individual provisions of these General Terms and Conditions be or become ineffective, this will not affect the legal validity of the remaining provisions. Furthermore, Lithos Natural GmbH reserves the right to make changes to these general terms and conditions at any time.
